Moss and Co represented a gentleman who was charged with assault causing actual bodily harm. It was alleged that he assaulted a lady with a wheel brace seized by officers from the boot of his car. The wheel brace was examined, the victim’s blood was discovered. There was a DNA match with the blood of the victim. Moss & Co’s client pleaded not guilty, denying any assault whatsoever. Moss & Co made their usual enquiries on disclosure and it was discovered that the same police officer who had treated the victim had also seized the wheel brace from the clients car; Moss & Co argued that the blood could have been transferred to the wheel brace by this officer. A not guilty verdict was returned.
